Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Spectrum Labs Limited Company ("we," "our," or "us") concerning your access to and use of the Remem mobile application (the "App").

By accessing or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the App.

Eligibility

You must be at least 13 years old to use the App. By using the App, you represent and warrant that you meet this age requirement.

If you are under 18 years old, you must have permission from a parent or legal guardian to use the App.

Subscription and Payments

Free Tier

The App offers a free tier with basic features including:

  • Creating and storing memories
  • Basic photo and text storage
  • AI-powered memory insights

Pro Tier

The Pro tier is available as a paid subscription and includes:

  • Enhanced AI features
  • Unlimited storage
  • Priority support
  • Advanced memory organization tools
  • Future integrations and features

Payment Terms

  • Subscriptions are processed through Apple's In-App Purchase system
  • Payments are managed by RevenueCat
  • All purchases are billed in accordance with the pricing and billing terms presented to you at the time of purchase
  • Prices are subject to change with notice

Auto-Renewal

  • Pro subscriptions automatically renew unless canceled at least 24 hours before the end of the current period
  • Your account will be charged for renewal within 24 hours prior to the end of the current period
  • You can manage subscriptions and turn off auto-renewal in your Apple ID Account Settings

Cancellation

  • You may cancel your subscription at any time through your Apple ID Account Settings
  • Cancellation takes effect at the end of the current billing period
  • You will retain Pro access until the end of the paid period
  • No refunds for partial subscription periods

User Content

Your Memories

  • You retain all ownership rights to the content you create in the App
  • You grant us a limited license to store, process, and display your content to provide the App's services
  • This license includes the right to use AI services (OpenAI) to analyze and enhance your memories

Content Guidelines

You agree not to create or upload content that:

  • Is illegal, harmful, or violates any laws
  • Infringes on intellectual property rights
  • Contains malware or harmful code
  • Is spam or unsolicited advertising
  • Harasses, threatens, or harms others
  • Contains explicit or adult content involving minors

Intellectual Property

The App and its original content, features, and functionality are owned by Spectrum Labs Limited Company and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

"Remem" and associated logos are trademarks of Spectrum Labs Limited Company. You may not use these trademarks without our prior written permission.

Privacy and Data Protection

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

Disclaimers

Service "As Is"

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. We do not guarantee that the App will meet your requirements or be uninterrupted, secure, or error-free.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE PAST 12 MONTHS, OR $100, WHICHEVER IS GREATER.

Termination

You may stop using the App and delete your account at any time through the Settings menu. We may suspend or terminate your account if you violate these Terms. Upon termination, all your data will be permanently deleted within 30 days.

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of significant changes by posting updated Terms in the App. Your continued use of the App after changes constitutes acceptance of the updated Terms.

Apple App Store Terms

If you download the App from the Apple App Store, you acknowledge and agree that:

  • These Terms are between you and Spectrum Labs Limited Company, not Apple
  • Apple is not responsible for the App or its content
  • Apple has no obligation to provide maintenance or support
  • Apple is not responsible for addressing any claims by you or third parties
  • Apple is a third-party beneficiary of these Terms
  • Upon your acceptance of these Terms, Apple has the right to enforce them against you
